Who owns the waves

In light of the debate over the foreshore and seabed here in NZ the Crooked Timber's discussion on surfing and property rights makes interesting reading:

What makes all this cooperation possible are a set of innate faculties to do with obligation, fairness, contract, punishment, entitlement etc.

Property rights are a mechanism by which we attempt to control the interaction between ourselves, others and the environment. We are born to develop a concept of "this is mine". Just look at any group of toddlers.
